The Avec on H Free Rent 2021 Sweepstakes (“Sweepstakes”) is sponsored by H Street Residential, LLC (“Sponsor”), and is administered by The Avec on H (“Administrator”). A person who submits an entry is referred to an “Entrant” and agrees to the terms set forth herein.
SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:01 a.m. on February 14, 2021 and ends at 11:59 p.m. (Eastern Standard Time) on March 31, 2021 (“Sweepstakes Period”). The Administrator’s computer is the Sweepstakes official clock. All entries, as defined below, must be received in the Sweepstakes Period to be included in the drawing.
ELIGIBILITY: This Sweepstakes is offered only to legal residents of forty-eight (48) United States (excluding Florida and New York) and the District of Columbia who are at least eighteen (18) years of age or older (exceptions: must be 19 years of age or older for those that reside in states of Alabama, Nebraska, and 21 years of age or older in state of Mississippi) at the time of entry and must further meet the Eligibility to Lease requirements as set forth below. Employees, directors, officers, members, and agents of Sponsor, Administrator, and each of their respective parent companies, divisions, franchisees, licensees, dealers, affiliates, subsidiaries, advertising/promotional agencies, distributors, retailers, suppliers, and persons engaged in the development, production or distribution of materials for this Sweepstakes (“Sweepstakes Entities”), as well as the members of each of their immediate families (spouse, parents, grandparents, children, grandchildren, siblings – whether biological, adopted, step or in-law) and persons residing in the same household as such individuals (whether related or not) are not eligible to enter or win (collectively, “Released Parties”). The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Florida, New York, Puerto Rico, the U.S. Virgin Islands, Guam, U.S. Military installations in foreign countries, and where prohibited by law.
ELIGIBILITY TO LEASE: To win the Grand Prize, Entrant must qualify to rent at The Avec on H and if selected as the Grand Prize winner, agree to pay all additional fees associated with the apartment above and beyond basic rent. Eligibility includes, but is not limited to, passing a criminal background check to qualify to rent at The Avec on H using the then-existing criminal background criteria. The winner must also not be involved in a pending bankruptcy case. Failure to meet any of the foregoing qualifications automatically voids the entry. The Sponsors, including The Avec on H, comply with all local, state and federal fair housing laws and are equal opportunity employers.
BINDING RULES: Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions and interpretations, which are final and binding in all matters related to the Sweepstakes.
HOW TO ENTER THE SWEEPSTAKES: Contest entries may be submitted via at least one of the following five (5) methods, each of which are given equal weight in the sweepstakes drawing:
(1) Renew your lease with the Sponsor (by March 31, 2021 ) for any unit in The Avec on H (901 H Street, NE, Washington, DC, 20002) property. All paperwork associated with the 2021-2022 lease must be fully executed. Entrants will need to provide the following information: first and last name, mailing address, telephone number and email address. Each fully executed renewal lease received by March 31, 2021 will receive one (1) Sweepstakes 1 entry.
(2) Initiate your lease with the Sponsor (by March 31, 2021) for any unit in The Avec on H (901 H Street, NE, Washington, DC, 20002) property. All paperwork associated with the lease must be fully executed. Entrants will need to provide the following information: first and last name, mailing address, telephone number and email address. Each fully executed new lease received by March 31, 2021 will receive one (1) Sweepstakes 1 entry.
(3) Complete an Online entry via website: loveavec.com (the “Website”). Entrants must accurately complete all required fields or the entry will be deemed incomplete and will not qualify.
NOTE: If accessing the Website via a mobile device, message and data rates may apply. Not all mobile telephone providers carry the service necessary to participate in this Sweepstakes. Entrants should consult their wireless provider’s pricing plans.
(4) Complete an On-site or Mail-In entry completing form provided by Sponsor, which contains all the information called for in an online entry on the website listed above. Entrants must accurately complete all required fields or the entry will be deemed incomplete and will not qualify. Mail-In entry forms are to be sent to The Avec on H, 901 H Street, NE, Washington, DC, 20002, postmarked no later than March 25, 2021 and received by March 30, 2021.
(5) Complete any of the actions defined on loveavec.com, which include one (1) entry via Following The Avec on H on Instagram during the Sweepstakes Period; one (1) entry via Liking The Avec on H on Facebook during the Sweepstakes Period; one (1) entry Sharing Contest Post on Instagram during the Sweepstakes Period; one (1) entry Sharing Contest Post on Facebook during the Sweepstakes Period.
LIMIT: Each Entrant is limited to receiving one (1) entry via Renewed Lease during the Sweepstakes Period; one (1) entry via New Lease during the Sweepstakes Period; one (1) entry via Online Entry during the Sweepstakes Period; one (1) entry via On-Site or Mail-In Entry during the Sweepstakes Period; one (1) entry via Following The Avec on H on Instagram during the Sweepstakes Period; one (1) entry via Liking The Avec on H on Facebook during the Sweepstakes Period; one (1) entry Sharing Contest Post on Instagram during the Sweepstakes Period; and one (1) entry Sharing Contest Post on Facebook during the Sweepstakes Period. Sponsor reserves the right, in its sole discretion, to void any and all entries of an Entrant that submits more than the stated maximum limit of entries by using multiple/different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Sweepstakes. Proof of entering information is not considered proof of delivery to or receipt by Sponsor of an entry. The use of automated entry devices is prohibited, and no mechanically reproduced entries are allowed; all such entries are void. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
RANDOM DRAWING: The Grand Prize Winner will be selected from among all the eligible entries received by the Administrator up to March 31, 2021, with One (1) Grand Prize winner randomly selected on April 1, 2021, by the Administrator, an independent organization, whose decisions are final and not subject to challenge and/or appeal in all matters relating to this Sweepstakes. The individual selected at the drawing is considered a potential winner pending verification of his/her eligibility and compliance with the Official Rules.
PRIZES, APPROXIMATE RETAIL VALUE, AND ODDS OF WINNING:
Grand Prize (1): There will be one (1) Grand Prize available to be awarded. The Grand Prize Winner (the “Grand Prize Winner”) will receive a twelve-month rent-free lease of an apartment, more specifically apartment number 532 (a 1 bedroom, 1 bath apartment) located at The Avec on H (901 H Street, NE, Washington, DC, 20002) apartment number 532, (hereinafter “Rental Unit”), inclusive of a security deposit and one-time administration and application fees. The rent-free time period will be from May 31, 2021 to May 30, 2022. The Approximate Retail Value (“ARV”) of the Grand Prize is $22,236.00 (current market value as of January 1, 2021). The Grand Prize may not be converted to cash, and in the event that the winner elects not to sign a lease with The Avec on H for the Rental Unit, the Winner is not to receive any prize. The Grand Prize Winner will be responsible for cable, electric, storage, trash, parking, utilities, taxes, and amenities not included in the basic rent, as well as any moving expenses incurred. In the event that the Grand Prize Winner elects to bring an animal, the Grand Prize Winner must sign an applicable animal addendum and pay any associated rents, fees or deposits. The Grand Prize Winner may have the option of selecting a roommate(s). The additional roommate will be subject to the same eligibility requirements as Grand Prize Winner. The Grand Prize winner must complete an apartment lease agreement and reside in the respective apartment throughout the prize duration. Grand Prize Winner is prohibited from subletting or utilizing the services of Airbnb or equivalent. Should the Grand Prize Winner not comply with any or all terms of the lease agreement, the lease will be terminated by the Sponsor and the Grand Prize Winner will be subject to eviction. Should the Grand Prize Winner fail to pay in full any cable, electric, storage, trash, parking, utilities, taxes, and amenities not included in the basic rent, the lease will be terminated and the Grand Prize Winner will be subject to eviction.
Odds of Winning: The odds of winning the Grand Prize depends on the total number of eligible entries received from all entries during the Sweepstakes Period.
Notification: Entrant who wins will be notified by telephone and/or e-mail provided with the entry. Upon initial notification and verification of the Grand Prize Winner, confirmation will be sent to the Grand Prize Winner via USPS mail, or other home delivery service of Sponsor’s choice. Email is deemed received when sent by Sponsor to Entrants.
General: No prize substitution or exchange will be allowed, except by Sponsor, who reserves the right to substitute a prize of equal or greater value in case of unavailability of the Grand Prize or force majeure. Winner shall be solely responsible for payment of any and all applicable federal, state, and local taxes for any prize won. Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner will be reported to the IRS as required by law. Each winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. All other costs and expenses not expressly set forth herein shall be solely the winner’s responsibility. The Sponsor shall not be held responsible for any delays in awarding The Grand Prize for any reason.
HOW TO CLAIM A PRIZE: Potential winners are subject to verification of eligibility and compliance with these Official Rules. Potential Grand Prize winners will be required to sign and return an application and any other requested documents within ten (10) business days from the date of attempted notification, and be able to begin residing in the apartment on May 31, 2021 or the Grand Prize may be forfeited in its entirety and awarded to an alternate winner, at the Sponsor’s sole and absolute discretion. Failure to provide all required information and signed documents within the stated time period may result in forfeiture of winner’s right to claim a prize and may result in the prize being awarded to an alternate winner, if time permits. Each potential winner may be subject to a background check before the Grand Prize is awarded. Upon verification of eligibility, Grand Prize winner will be contacted by Sponsor or Administrator to arrange for Grand Prize fulfillment. If a potential winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept his/her prize, or any winner notification is returned as undeliverable or the potential winner fails to respond to a winner notification within the timeframe specified in such winner notification, the prize may be forfeited. If a prize is forfeited for any reason, it may be awarded to an alternate potential winner, at the Sponsor’s sole and absolute discretion, selected at random from the remaining pool of eligible entries received for the applicable Sweepstakes Period, time permitting.
Prizes are not transferable to third parties.
LIMITATION OF LIABILITY: By participating in this Sweepstakes, Entrants agree that the Sweepstakes Entities and each of their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers and each their respective officers, directors, stockholders, employees, representatives, designees and agents (“Released Parties”) are not responsible for: (i) lost, late, incomplete, stolen, misdirected, postage due or undeliverable e-mail notifications, telephone calls, or postal mail; (ii) any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, or availability; (iii) garbled, corrupt or jumbled transmissions, service provider/Internet/Website/UseNet accessibility, availability or traffic congestion; (iv) any technical, mechanical, printing or typographical or other error; (v) the incorrect or inaccurate capture of registration information or the failure to capture, or loss of, any such information; (vi) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Website; (vii) any injury or damage, whether personal or property, to entrants or to any person’s computer related to or resulting from participating in the Sweepstakes and/or accepting a prize; and (viii) entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules. Further, the Sweepstakes Entities are not responsible for any undelivered telephone calls, messages or e-mails, including without limitation, e-mails that are not received because of an entrant’s privacy or spam filter settings that may divert any winner notification or other Sweepstakes related e-mail to a spam or junk folder.
By entering the Sweepstakes, each entrant agrees: (i) to be bound by these Official Rules, including entry requirements; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his/her rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Sweepstakes; and (iv) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable attorneys’ fees) that may arise in connection with: (a) the Sweepstakes, including, but not limited to, any Sweepstakes-related activity or element thereof, and the entrant’s entries, participation or inability to participate in the Sweepstakes; (b) the violation of any third-party privacy, personal, publicity or proprietary rights; (c) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof); (d) any change in the prizing (or any components thereof); (e) human error; (f) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (g) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof); or (h) the negligence or willful misconduct by Released Parties.
If, for any reason, the Sweepstakes is not capable of running as planned, or the integrity and or feasibility of the Sweepstakes is severely undermined by any event beyond the control of Sponsor, including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures or other cause not reasonably within the control of Sponsor (each a “Force Majeure” event or occurrence), Sponsor reserves the right, at its sole and absolute discretion, to abbreviate, cancel, terminate, modify or suspend the Sweepstakes and/or proceed with the Sweepstakes, including the selection of a Grand Prize winner in a manner it deems fair and reasonable, including the selection of a Grand Prize winner from among eligible entries received prior to such cancellation, termination, modification or suspension without any further obligation provided a sufficient number of eligible entries are received. If Sponsor, in its discretion, elects to alter this Sweepstakes as a result of a Force Majeure event, a notice will be posted at the Website.
Without limiting the foregoing, everything regarding this Sweepstakes, including the Grand Prize, is provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
RELEASES: All Entrants, as a condition of participation in this Sweepstakes, agree to indemnify, release and hold harmless the Sponsor, Released Parties, and their affiliates, designees and assigns and all of their respective officers, directors, employees, representatives and agents, from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor’s Website; (b) participating in any aspect of the Sweepstakes, including, without limitation, while preparing for, participating in and/or traveling to or from any prize or Sweepstakes-related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any prize awarded; (d) viruses or any downloading or other problems with the Sweepstakes Application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any prize.
DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE DISTRICT OF COLUMBIA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE SOLELY IN THE COURTS OF THE DISTRICT OF COLUMBIA. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL DAMAGES OR TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR SWEEPSTAKES ENTITIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
JURY TRIAL WAIVER: IN THE EVENT OF LITIGATION BETWEEN AN ENTRANT AND SPONSOR, ARISING OUT OF OR RELATED TO THIS SWEEPSTAKES, THE PARTIES EXPRESSLY WAIVE THEIR RIGHT TO TRIAL BY JURY.
ATTORNEYS FEES AND COSTS: IN THE EVENT OF LITIGATION, THE PREVAILING PARTY SHALL BE ENTITLED TO REASONABLE ATTORNEYS’ FEES AND COSTS.
PERSONAL INFORMATION/OPT-IN: By entering the Sweepstakes, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Sweepstakes; the information that you provide in connection with the entry process will be used by Sponsor only, and will not be sold or provided to another company. You are authorizing the Sponsor to send you emails to the address entered on entry form, regarding product offerings. You may opt out of receiving future e-mails from Sponsor by clicking on the link contained in any e-mail received. You will remain eligible for this Sweepstakes whether or not you opt out of receiving the e-mails.
PUBLICITY RIGHTS: By participating in the Sweepstakes and/or accepting a prize, each Entrant agrees to allow Sponsor and Sponsor’s designee the perpetual right to use his/her name, biographical information, photos and likeness, Content, voice recording, video images and all related footage, and statements for Sweepstakes, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered worldwide, including but not limited to television (including live television), radio, and Internet, without notice, review or approval and without additional compensation except where prohibited by law.
CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of a winner, the winning entry will be declared made by the authorized account holder of the e-mail address submitted on the registration form associated with such entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each entrant may be required to show proof of being an authorized account holder. If any provision of these Official Rules or any word, phrase, clause, sentence or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or any prize documents will not affect the validity or enforceability of any other provision. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All entries and/or materials submitted will not be returned. In the event of any conflict with any Sweepstakes details contained in these Official Rules and the Sweepstakes details contained in any Sweepstakes promotional materials (including, but not limited to, point of sale, television and print advertising, promotional packaging and other promotional media), the details of the Sweepstakes as set forth in these Official Rules shall prevail.

WINNER LIST REQUEST: To request confirmation of the name and city/state of residence for the winners, please send a self-addressed, stamped business-sized envelope, by May 31, 2021 to: ”Avec on H 2020 One Year Free Rent” Sweepstakes Winners List, c/o The Avec on H, 901 H Street, NE, Washington, DC, 20002. Requests received after April 1, 2021 will not be acknowledged or returned.
In the event that the Grand Prize Winner is an Entrant who entered into the Sweepstakes by renewing or initiating a standard lease which term commences before May 31, 2021 and expires before May 31, 2022, the Grand Prize Winner shall have the option of terminating such standard lease by May 31, 2021 at which any early termination fees will be waived by Sponsor or entering into a short-term lease with Sponsor for the Grand Prize Winner’s desired term.
